Vipra Business Forum and its affiliates / franchises provide their services to you subject to the following terms and conditions. When you use or visit any current or future Vipra Business Forum service or any business affiliated with Vipra Business Forum, whether or not included in the Vipra Business Forum Web site, you will also be subject to the guidelines and conditions applicable to such service or business. Please read the various services provided by Vipra Business Forum before making any payment in respect of any service.

Every user of this website is bound to agree the terms and conditions below. In order to use the viprabusinessforum.com website (“Site”), you must register as a member of the Site (“Member”) and agree to be bound by these Terms of Use (“Agreement”) and the Privacy policy. If you wish to become a Member and communicate with other Members and make use of the Vipra Business Forum (“Service”), read these Terms of Use and follow the instructions in the Registration process. This Agreement sets out the legally binding terms between you as a member and the owner of the site Vipra Business Forum, Bangalore. This Agreement may be modified by Vipra Business Forum from time to time, effective upon notice to you as a Member.

The services offered herein and all matters incidental thereto, and will be in effect until such time that you continue using this Website or, in case of a member, until such time that the member retains his/her membership subscription of Vipra Business Forum, whichever is later.

We encourage you to refer to these terms and conditions on a regular basis. Please review them timely as they may be revised, amended or modified. If you do not agree to any revisions, amendments and modifications, you should immediately terminate your use of the Website. Should you continue to use the Website after any revisions, amendments and modifications, you will be deemed to have agreed to such revisions, amendments and modifications.

Eligibility.

As per the policy of the Vipra Business Forum, A member should be from a Vipra Community and should of 18+ years as on the date of his/her registration at VBF. He/ She should own / represent a legal Business or willing to start any kind of legal Business. By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

Regulations of your “USER” Account.

This Agreement will remain in full force and effect until

1. You use the Site and/or are as a Member of Vipra Business Forum.
2. You terminate your membership at any time, for any reason by writing to Vipra Business Forum or by choosing the option to terminate your membership at VBF.
3. Vipra Business Forum terminates your access to the Site and/or your membership for any reason effective upon sending notice to you at the email address that you have provided in your application for membership or your updated email address during your registration or amended details at VBF.
4. Vipra Business Forum terminates your membership in the viprabusinessforum.com Service because for having breached the Agreement by the member.
5. Upon non-activity on the website from the member for more than 360 days.

For what-so-ever reason if the membership is terminated by you / Vipra Business Forum, you will not be entitled to any refund of any unused Subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect including all sections inclusive, of this Agreement.

You are responsible for all activities that may occur under your account and password. Please maintain the confidentiality of your account and password and for restricting access to your computer systems. You will be responsible for the content posted by such other person. Vipra Business Forum is not obligated to verify the veracity and accuracy of information displayed by you.

You also hereby expressly agree that the information provided by you is available to the other users of Vipra Business Forum. Vipra Business Forum neither has any control nor any responsibility or accountability if your information is misused, exploited or abused by any third party.

You are permitted to have only one user profile. In the event of multiple user profiles of a single member, we reserve the right to deactivate any such or all profiles. Vipra Business Forum’s discretion to terminate shall be final and binding.

You will not send any messages to other Members that are obscene, lewd, licentious, and defamatory, promote hatred and/or are racial or abusive in any manner. Transmission of any such messages shall constitute a breach of this Agreement.

Non-Commercial Use by Members.

Vipra Business Forum website and its services are for the use of individual members and to the public and may not be used in connection with any commercial purposes.

We may also immediately terminate your membership from the Website if we have reason to believe that you are not eligible to use the Website or you are using the Website for unauthorized purposes. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be will be dealt with in accordance with law.

You will not transmit any chain letters or junk email to other Vipra Business Forum Members. It is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

In order to protect Vipra Business Forum and/or our Member(s) from any abuse / misuse, Vipra Business Forum reserves the right to restrict the number of communications / profile contacts & responses / emails which a Member may send to other Member(s).

You may not use any automated processes, including IRC Bots, EXE’s, CGI or any other programs/scripts to view content on or communicate / contact / respond / interact with Vipra Business Forum and/or its members.

Vipra Business Forum contains the logo, Graphics, page headers, button icons, Software(s), Script(s), copyrighted material, trademarks, intellectual property rights and other proprietary information. Except for that information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

Content Posted on the Site.

Your profile details, photos, Business Information, communications and messages collectively hereinafter called as “Content”.

You are solely responsible for the Content that you publish or display (hereinafter, “post”) on Vipra Business Forum, or transmit to other Vipra Business Forum Members. Vipra Business Forum reserves the right to verify the authenticity of Content posted on the site. In exercising this right, Vipra Business Forum may ask you to provide any documentary or other form of evidence supporting the Content you post on the site. If you fail to produce such evidence, Vipra Business Forum, in its sole discretion, terminate your Membership without a refund.

To publish/modify/ delete any of its part/complete is the sole judgment of Vipra Business Forum for which the content might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other Vipra Business Forum and/or its Members.

By posting Content on Vipra Business Forum, you automatically grant, and you represent and warrant that you have the right to grant, to Vipra Business Forum, and other Vipra Business Forum Member(s), an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Every Profile created by the user will be scrutinized by our team for correctness of the contents. Minor corrections such as spelling mistake, unnecessary characters etc. and minor editing of photos such as cropping and resizing, adjusting brightness and contrast will be done by the team. The team ensures to correct / complete the profile by calling the contact person on the mentioned mobile number given at the time of registration. In such cases we advise the member to verify the contents immediately after it. In case of any changes the member can correct the same by logging on to the website with his username and password or inform us by mail / phone to do so.

The following is a partial list of the kind of Content that is illegal or prohibited on the Site. Vipra Business Forum will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the Membership of such violators without a refund. It includes content that:

1. is seriously offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
2. harasses or advocates harassment of another person;
3. involves the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing or “spamming”;
4. promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
5. promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing links to pirated files;
6. contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;
7. displays pornographic or sexually explicit material of any kind;
8. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
9. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
10. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
11. Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

You must use the Vipra Business ForumService in a manner consistent with any and all applicable local, state, and federal laws and regulations.

You may not include in your Member profile, visible to other members, any telephone numbers, street addresses, last names, URL’s, and email addresses.

Membership Policy.

Vipra Business Forum reserves the right to Approve, Disapprove, Activate, Deactivate, discontinue the user as Free / Paid member to its website at any time. Following are partial list the user / member policies that every member must agree and follow

1. Vipra Business Forum does not guarantee / authenticate the genuineness of the contents provided by the member. Every member submitting his/her matrimonial profile is required to give all the facts essential for establishing a marital relation. Concealing facts relevant to marriage could result in loss or damage to any individual and for which, Vipra Business Forum cannot be held responsible / liable in any way for the damages caused due to incorrectness of the information provided by its members regarding the religion, caste or creed or any other personal information. If the members’ profile is deemed to be unfit, Vipra Business Forum has the right to delete, alter or refuse the same at any point of time without any notice.

 2.     Vipra Business Forum does not facilitate / hold responsible for connection with other member. You are only liable for your connections with other members.

 3.     Members will not have any claim against Vipra Business Forum for any time delay in posting their information into Vipra Business Forum website due to any technical reasons. 

 4.     Vipra Business Forum will not mediate / arbiter, hold any moral / legal responsibility for any kind of disputes between its members.

 5.     Vipra Business Forum will not guarantee the members that you as an applicant will receive responses and hence cannot be held responsible for no replies. In this case we cannot give any refunds or credits.

 6.     By becoming a Member of the Vipra Business Forum, you agree to receive certain specific Telephone / Mobile calls, emails and SMS from Vipra Business Forum on the telephone / mobile number and e-mail ID provided by you on your profile explain, explicate and clarify the various services and to assist, aid or support you in availing the said services of Vipra Business Forum.  

 7.     You are representing that you or the mobile number submitted by you is not registered with the Do Not Disturb / National Customer Preference Register and/or you have already changed your registration suitably. Further and in any event, you do hereby also unconditionally agree and undertake that this invitation and solicitation shall supersede any preferences set by you with or registration done with the Do Not Disturb (“DND Register”)/ National Customer Preference Register (“NCPR”). Without prejudice to the aforesaid and in any event, by expressly inviting and soliciting the services from Vipra Business Forum, you also unconditionally agree that your rights under the Telecom Commercial Communications Customer Preference Regulations, 2010 or any subsequent amendments thereto or under NCPR, are kept in abeyance or remain extinguished till you expressly communicate for discontinuation of relationship.

 8.     You are under an obligation to report any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or anything which is in violation of this Agreement, you shall forthwith report such violation to Vipra Business Forum by writing to Customer Care. On receipt of such complaint, Vipra Business Forum may investigate such complaint and if necessary may terminate the membership of the Member responsible for such violation abuse or misuse without any refund of membership fee. Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the membership fee.

Copyright Policy.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Vipra Business Forum service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the our Site; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Member Disputes.

 You are solely responsible for your interactions with other Vipra Business Forum Members. Vipra Business Forum reserves the right, but has no obligation, to monitor disputes between you and other Members.

Disclaimers.

Vipra Business Forum is not responsible for any incorrect or inaccurate content posted on the Site or in connection with the Vipra Business Forum service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the Vipra Business Forum service whether online or offline. Vipra Business Forum assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications.

Vipra Business Forum is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Users and/or Members or to any other person’s computer related to or resulting from participating or downloading materials in connection with the Vipra Business Forum Site and/or in connection with the Vipra Business Forum service.

 Under no circumstances will Vipra Business Forum be responsible for any loss or damage resulting from anyone’s use of the Site or the Service and/or any Content posted on the Vipra Business Forum Site or transmitted to Vipra Business Forum Members. The exchange of Business profile(s) through or by Vipra Business Forum should not in any way be construed as any Business offer and/or recommendation from/by Vipra Business Forum.

Vipra Business Forum shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, matrimonial relations established pursuant to the use of Vipra Business Forum. The Site and the Service are provided “AS-IS” and Vipra Business Forum expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Vipra Business Forum cannot guarantee and does not promise any specific results from use of the Site and/or the Vipra Business Forum Service.

Limitation on Liability.

Except in jurisdictions where such provisions are restricted, in no event will Vipra Business Forum be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the Vipra Business Forum Service, even if Vipra Business Forum has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Vipra Business Forum, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Vipra Business Forum, for the Service during the term of membership.

Disputes.

If there is any dispute about or involving the Site and/or the Service, by using the Site, you agree that the dispute will be governed by the laws of the State of Karnataka, India without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and central courts of the Bangalore, India.

Privacy.

Use of the Vipra Business Forum Site and/or the Vipra Business Forum Service is governed by the Vipra Business Forum Privacy Policy.

Indemnity.

You agree to indemnify and hold Vipra Business Forum, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

Other.

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Vipra Business Forum, contains the entire agreement between you and Vipra Business Forum regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

 By joining Vipra Business Forum, you confirm that you have read the above provisions and agree to abide by them.
